This policy explains what UpperHand Claims ("we", "us") collects on upperhandclaims.com, why, and who receives it. The short version: you give us your contact details so that a lawyer or a funding provider can help you, and we share them for that purpose. We are paid for those referrals.
What we collect
- What you type into the form: your name, phone number, ZIP code, and whether you already have a lawyer for your accident.
- Case-worth tool answers: if you use the estimator and then submit the form, your four answers and the range shown are sent along with your request. If you only use the estimator and never submit the form, your answers stay in your browser and are not sent to us.
- Consent record: the date and time you submitted, your IP address, your browser's user agent, the page you submitted from, and which version of the consent wording you were shown.
- Usage data: when analytics and advertising tags are active on the site, they use cookies or similar identifiers to measure visits and whether an ad led to a request.
How we use it
- To call or text you about your request and understand your situation.
- To connect you with an independent, licensed Florida attorney or attorney referral network, or with a third-party pre-settlement funding provider, depending on what you asked for.
- To keep proof of the consent you gave, which the law and our partners require.
- To prevent spam and abuse, and to measure and improve the site and our advertising.
Who we share it with
We share your request with third parties, and we are compensated for doing so. That is how this service stays free for you. Specifically:
- Attorneys and attorney referral networks, if you told us you do not have a lawyer.
- Pre-settlement funding providers, if you told us you already have a lawyer.
- Service providers that host the site, store requests, and deliver calls, texts and email on our behalf.
- Authorities, when the law requires it or to protect legal rights.
Once a partner receives your information, their own privacy policy governs how they use it.
Calls and texts
When you submit the form you agree that UpperHand Claims and its partners may call or text you about your inquiry, including by automated means. Consent is not a condition of any service. Message and data rates may apply. You can stop texts at any time by replying STOP, and you can ask any caller to stop calling you.
Cookies and analytics
The site works without cookies. Analytics and advertising tags, when active, may set cookies to measure visits and conversions. You can block or delete cookies in your browser settings without losing access to the site.
How long we keep it
We keep requests and their consent records for as long as needed to provide the service and to meet legal and record-keeping obligations, then delete or anonymize them.
Your choices
You can ask us what we hold about you, ask us to correct or delete it, or ask us to stop contacting you. See our contact page for how to reach us. Deleting your record with us does not automatically delete it from a partner who has already received it; ask them directly as well.
Children
This site is for adults. We do not knowingly collect information from anyone under 18.
Security
We limit who can see requests and use reasonable safeguards to protect them. No website can promise perfect security, so please do not put medical records, claim numbers, or other sensitive details into the form.
Changes
If we change this policy, we will post the new version here and update the date at the top.
